1. Acceptance of these Terms
By accessing or using the Site, creating an account, submitting content, or interacting with property listings (collectively, Services), you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions (Terms) and our Privacy Policy. If you do not agree, you must not use the Services.
2. Who we are (Portal, not agent)
We are an online portal/aggregator that displays property information sourced from third‑party agents, agencies, CRMs, data providers and public sources. We are not a real estate agent, licensee, buyer’s agent or vendor’s representative. We do not:

negotiate, prepare or execute contracts of sale or leases; or

hold trust monies.
Any engagement for agency services is strictly between you and the third‑party agent.
3. Eligibility & Australian use
The Services are intended for use in Australia. You must be at least 18 years old and capable of entering into a legally binding contract to use the Services. If you access the Services outside Australia, you are responsible for compliance with local laws.
4. Accounts & security
You may browse some pages without an account. Certain features (saved searches, favourites, alerts, messages) require registration. You agree to:

5. Listings & third‑party content
5.1 Source of listings. Listings and media may be supplied by third‑party owners, sellers, agents/agencies or their CRMs by data partners, or collected from publicly available sources with attribution.
5.2 No warranty of accuracy. While we aim for accuracy, we do not guarantee any listing’s completeness, availability, price, attributes, or suitability. Properties may be withdrawn, sold, or changed without notice. Always confirm details (including zoning, short‑stay rules, services, rates, lot boundaries, flood/erosion risk, building approvals and rental/yield figures) with the source agent and relevant authorities.
5.3 Links. Our “View full listing”/external links are provided for convenience. We do not control or endorse third‑party websites and are not responsible for their content, terms or privacy practices.
5.4 Removal/corrections. We may modify, annotate, flag, or remove listings or materials at any time (including upon request from rights holders or agencies) without liability to you.
6. No professional advice
All information on the Services is general in nature and provided for information only. It is not legal, financial, tax, town‑planning or other professional advice. You should obtain independent advice and conduct your own inspections and due diligence before any purchase or booking decision.
7. User submissions & reviews
If you submit reviews, comments, questions, photos or other content (User Content):

you grant us a worldwide, non‑exclusive, royalty‑free licence to use, reproduce, modify, publish and display the User Content for operating and promoting the Services;

you warrant you own or have rights to the User Content and it is accurate, lawful, and not misleading;

you must not upload anything defamatory, obscene, infringing, invasive of privacy, false, or harmful.
We may moderate, edit or remove User Content at our discretion.
8. Data feeds, APIs & bulk access
Access to data feeds, APIs or bulk downloads is prohibited unless expressly permitted by separate written agreement. We may audit use and suspend access for misuse.
9. Paid features & subscriptions (if applicable)
If we offer paid features (e.g., premium alerts, market data, or buyer tools):

prices are in AUD and inclusive/exclusive of GST as stated;

billing terms will be presented at checkout;

recurring subscriptions renew automatically unless cancelled prior to the end of the term;

refunds are handled in accordance with Australian Consumer Law (ACL) and any stated refund policy.

11. Australian Consumer Law (ACL)

13. Liability limitation

Subject to the ACL, our aggregate liability to you for all claims is limited to the greater of: (a) AUD $100; or (b) the total fees you paid to us (if any) in the 12 months preceding the claim.
14. Indemnity
You indemnify us (and our personnel) against all losses, claims, costs and liabilities arising from your breach of these Terms, your misuse of the Services, or your infringement of any third‑party rights.
15. Takedown procedure (IP/Content complaints)

We will review and respond within a reasonable time.
16. Short‑stay & local regulations
Short‑stay/Airbnb‑style use of a property may be subject to local council, strata/body‑corporate, state or title restrictions (including registration, permits, occupancy caps, parking, waste and fire safety). We do not guarantee a property’s suitability for short‑stay use. You must confirm requirements with relevant authorities and your legal adviser.
17. Changes to the Services and Terms
We may update the Services and these Terms at any time. Changes take effect upon posting to the Site with the “Last updated” date revised. Your continued use constitutes acceptance of the updated Terms.
18. Suspension & termination
We may suspend or terminate the Services (in whole or part) or your access immediately if you breach these Terms, we suspect misuse, or for operational/security reasons. Clauses that by their nature should survive termination do so (including IP, disclaimers, limitation of liability, indemnities, and governing law).
19. Governing law & disputes
These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia. Before commencing proceedings, you agree to attempt to resolve disputes by good‑faith negotiation; if unresolved after 30 days, either party may pursue available remedies.
20. General
If any provision is invalid or unenforceable, it will be severed and the remainder will continue in full force. Our failure to enforce any right is not a waiver.
